Effective Date: January 1, 2025
This Hosting Plan Agreement ("Agreement") is entered into by and between Patriot Pixels LLC, a Florida limited liability company ("Company," "we," "our," or "us"), and the client ("Client," "you," or "your"). This Agreement governs the terms and conditions under which Patriot Pixels LLC provides web hosting services to you.
We provide managed web hosting services, which may include website storage, domain management, routine updates, technical support, and security monitoring. The exact services provided depend on the hosting plan you select.

Any unused revision time does not roll over. Revisions exceeding the included time are billed at our standard hourly rate. Additional emails or special configurations may be offered as paid add-ons.
Clients may upgrade or downgrade their hosting plan at any time, including during the initial 6-month hosting commitment. If a Client downgrades from the Pro Plan to the Plus Plan, access to any included custom email addresses will be revoked unless the email service is purchased separately as an add-on. Feature changes will take effect on the next billing cycle following the plan change request.
The following add-on services are available for purchase to enhance your hosting plan. All add-ons are subject to availability and may be updated, paused, or discontinued at any time without prior notice.
All add-ons must be paid in full prior to activation. Unused revision hours purchased separately do not roll over unless otherwise specified in writing.
The minimum term for all hosting plans is six (6) months unless otherwise specified. Your plan will automatically renew month-to-month thereafter unless canceled in accordance with this Agreement.
By subscribing to a hosting plan, you authorize Patriot Pixels LLC to automatically charge your payment method on file for the monthly or annual fee associated with your selected plan, including any applicable add-ons. These charges will occur on a recurring basis, as defined by your chosen billing cycle. You acknowledge and agree to this automatic billing structure and understand that it will remain in effect unless you cancel your plan in writing prior to your renewal date. Charges for add-ons are also subject to this same automatic billing unless stated otherwise.
If payment is not received within three (3) calendar days or seventy-two (72) hours of the due date, your account will be suspended, and your website will be replaced with a temporary maintenance notice. If payment is still not received within seven (7) calendar days or one hundred sixty-eight (168) hours, your hosting plan will be canceled and/or terminated. In such cases, you may be subject to an early termination fee as outlined in this Agreement. Reactivation of service after cancellation may require a new hosting plan subscription and payment of all past due balances and applicable reactivation fees. Patriot Pixels LLC is not liable for any loss of data, revenue, reputation, or business opportunity resulting from suspension, cancellation, or termination due to nonpayment.
You may cancel your hosting plan at any time by providing written notice via email. If you cancel within the initial 6-month commitment period, you agree to pay an early termination fee of $400, minus any hosting fees you have already paid. This fee must be paid in full within seven (7) calendar days of cancellation. Failure to pay may result in the account being sent to collections or other legal remedies.
After the initial 6-month term has been completed, you may cancel your hosting plan at any time without incurring an early termination fee. In such cases, your website will remain live and accessible until the end of your current billing cycle. At the conclusion of that billing cycle, your subscription will not renew, your hosting plan will be terminated, and your website will be taken offline.
We reserve the right to terminate hosting services at any time, with or without notice, for violation of this Agreement, our Acceptable Use Policy, failure to pay, or for any behavior deemed abusive, unlawful, or inappropriate.
Upon cancellation or termination, your website will be taken offline. You may request a copy of your content, excluding any proprietary code, design, or assets owned by Patriot Pixels LLC. We are under no obligation to retain your data after fifteen (15) days post-termination. Reactivation of terminated accounts is at our sole discretion and may be subject to new service agreements and payment of past due balances
You agree to use our hosting services only for lawful purposes and in compliance with our Acceptable Use Policy.
We implement standard security protocols but cannot guarantee absolute protection against all threats. Clients are responsible for maintaining backups of their content unless otherwise stated in the selected hosting plan.
Excessive use of system resources may result in suspension or limitation of your services. If your site outgrows your current plan, you may be required to upgrade.
All custom themes, templates, domain names, layouts, and backend configurations created by Patriot Pixels LLC remain our intellectual property. Clients are granted a limited license to use them only while subscribed to an active hosting plan.
You retain ownership of any content you personally provide, such as logos, images, and text. You represent that all such content is lawful and does not infringe upon any third-party rights.
To the maximum extent permitted by law, Patriot Pixels LLC shall not be liable for any indirect, incidental, or consequential damages, including data loss, loss of profits, or service interruptions, resulting from use or inability to use the hosting services.
We reserve the right to update or modify this Agreement at any time. Any changes will be posted on our website. Continued use of our services constitutes acceptance of the updated terms.
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida without regard to its conflict of law principles.
This Agreement, along with any related documents referenced herein, constitutes the entire agreement between you and Patriot Pixels LLC regarding hosting services and supersedes all prior discussions, communications, or agreements.
By subscribing to a hosting plan, you acknowledge that you have read, understood, and agreed to the terms of this Hosting Plan Agreement.
